The Legal Landscape of Delta-9 THC in the United States

Most people know Delta-9-tetrahydrocannabinol, or Delta9-THC as the psychoactive compound in marijuana. Because of the reputation it’s gained as “high” inducing, this cannabinoid has had a turbulent legal journey in the United States. But despite this stigma, delta-9 actually has a number of benefits to offer. If you are curious about the ways that delta-9 THC could benefit you, but you have concerns about its legal status, give this article a read!

The History of Delta-9 Legality

The legal history of Delta-9 THC begins with the Marihuana Tax Act of 1937, which effectively criminalized cannabis. This prohibition era, culminating in the Controlled Substances Act of 1970, classified cannabis as a Schedule I substance, alongside other drugs considered to have high potential for abuse and no accepted medical use. Under this classification, Delta-9 THC became illegal at the federal level, despite growing evidence of its medicinal benefits.

The 21st century marked a significant shift in the perception and legal status of Delta-9 THC. California’s 1996 Proposition 215 allowed for the medical use of cannabis, including Delta-9 THC, with a physician’s recommendation. In 2012, Washington and Colorado became the first two states to legalize recreational cannabis. Earlier this year, the Justice Department submitted a proposal to reclassify marijuana from a Schedule I to a Schedule III substance. This is yet another step towards widespread recognition and acceptance of the many potential benefits of delta-9 THC.

Is Delta-9 Legal?

The US Farm Bill was passed in 2018, which federally legalized hemp products under the stipulation that they contain no more than 0.3% delta-9 THC. It should also be noted that the list of states which have legalized recreational cannabis continues to grow. California, New York, and Illinois are just a few states that have joined the list so far. Despite this progress, cannabis, and therefore, delta-9 THC, has not been entirely legalized on the federal level. This means that individual states have their own delta-9 THC regulations, which should always be confirmed before purchasing or using cannabinoids.
